Terms of Service

These Terms of Service ("Terms") govern your access to and use of the IXAY application and website ("IXAY", the "Service"). IXAY is operated by an individual developer based in Thailand ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

IXAY is a real-time screen translation application for Windows that translates on-screen text and includes optional learn-as-you-go vocabulary features. Features and availability may change as the Service evolves.

To use most features you must create an account with a valid email address and keep your login credentials secure. You are responsible for activity that occurs under your account.

2. Eligibility and acceptable use

You agree to use IXAY only for lawful purposes and not to:

  • reverse engineer, decompile, or attempt to extract source code or credentials from the Service, except to the extent this restriction is prohibited by law;
  • resell, redistribute, or provide the Service to third parties without our permission;
  • attempt to circumvent usage limits, quotas, or access controls;
  • use the Service to translate or process content in a way that infringes others' rights or violates applicable law;
  • interfere with or disrupt the integrity or performance of the Service.

We may suspend or terminate accounts that violate these Terms.

3. Plans, pricing, and payment

IXAY offers a free plan and paid plans. Current plans and prices are shown in the app and/or on our website.

  • Free plan: available at no cost, subject to the limits shown in the app.
  • Paid plans (monthly): billed as an auto-renewing subscription. Your payment method is charged at the start of each billing period and automatically renews until you cancel.
  • Paid plans (annual): billed as a one-time payment that grants access for 365 days from the date of purchase. Annual plans do not auto-renew; you may renew manually before or after expiry (renewing extends your access by a further 365 days).

Payments are processed by Stripe. By purchasing, you authorize the applicable charge and agree to Stripe's terms in addition to ours. Prices are subject to change; changes will not affect the term you have already paid for.

4. Cancellation

  • Monthly plans: You may cancel at any time. Cancellation takes effect at the end of your current billing period — you keep access until then, and you will not be charged again after that. We do not provide partial refunds for the unused portion of a billing period.
  • Annual plans: An annual plan is a one-time purchase for a fixed 365-day term. There is nothing to "cancel" — access simply ends at expiry unless you renew. Annual purchases are not pro-rated.

You can manage or cancel your subscription through the account/billing area in the app.

5. Refund Policy

Please choose your plan carefully. Because IXAY is a digital service delivered immediately:

  • Monthly plans: payments are non-refundable, including for the unused portion of a billing period after you cancel. Cancellation stops future charges (see Section 4).
  • Annual plans: the one-time annual payment is non-refundable and is not pro-rated for unused time.
  • Exceptions: We may, at our discretion, provide a refund where required by applicable law, or in the case of a duplicate charge or a proven billing error. To request a review, contact hello@ixay.app with your account email and details of the charge.

Nothing in this policy limits any non-waivable statutory rights you may have under the consumer-protection laws of your country.

6. Your content and data

You retain your rights in the content you translate. We process it only to provide the Service, as described in our Privacy Policy. We do not store screenshots or screen captures, and we do not sell your data.

7. Service availability and changes

We aim to keep IXAY available and reliable, but the Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features, in whole or in part, at any time. Translation output is generated by automated systems and may contain errors; do not rely on it for critical, legal, medical, or safety-related decisions.

8. Third-party services

IXAY relies on third-party providers (including Supabase, Google, Stripe, and Resend) to operate. We are not responsible for the availability or performance of these third-party services, and your use of them may be subject to their own terms.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that translations will be accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the extent we are found liable, our total liability will not exceed the amount you paid to us for the Service in the twelve (12) months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including payment obligations, disclaimers, and limitations of liability) will survive.

12. Governing law

These Terms are governed by the laws of Thailand, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection laws of your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated where appropriate. Your continued use of the Service after an update means you accept the revised Terms.
